Getting Started

Documents required for trademark registration

Most applications need only a few documents. Exact requirements depend on who is applying; you’ll get a precise checklist for your case.

  • Applicant’s name, address and nationality, or business name and type of entity
  • The brand name, and the logo as an image file if you are registering one
  • A list of the goods or services you sell under the brand
  • Date of first use, with supporting proof, if the brand is already in use
  • Identity and address proof; for firms and companies, registration or incorporation documents
  • Udyam (MSME) or Startup India certificate, if you have one: eligible applicants pay a lower government fee
  • Signed authorisation (Form TM-48) for your advocate to file on your behalf

Common Questions

Trademark FAQs

Who can apply for a trademark?

Any individual, sole proprietor, partnership firm, LLP, company, trust or society can apply. You don’t need to be a registered company to protect your brand.

When can I use the ™ and ® symbols?

You can use ™ once your application is filed, to signal that you claim the mark. The ® symbol may only be used after the trademark is registered; using it before then is an offence under the Trade Marks Act.

What is a trademark “class”?

Goods and services are divided into 45 classes (34 for goods, 11 for services). Your trademark is protected in the classes you file in, so choosing them correctly matters. A business may need more than one class.

How long does trademark registration take in India?

An application that faces no objection or opposition can move through in several months; if objections or oppositions are raised it can take longer. Your rights date back to the filing date once the mark is registered.

I received an objection. Is my application rejected?

No. An examination report raising objections is a normal part of the process, and many marks are accepted after a well-drafted reply. The reply must generally be filed within 30 days of receiving the report, so act quickly.

What happens if someone opposes my trademark?

After publication in the Trade Marks Journal, anyone can file an opposition within four months. You then have two months to file a counter-statement, after which both sides file evidence and the matter is heard. Not responding in time means the application is treated as abandoned.

How long does a registered trademark last?

Ten years from the date of application, and it can be renewed every ten years indefinitely. Renewal can be filed up to a year before expiry, and there is a limited grace period afterwards with an additional fee.
